Terms and Conditions
These Terms and Conditions of Sale are governed by AS Surgitech, registration code 10453754, Pärnu mnt 148.
In addition to these Terms and Conditions, legal relations arising from the distribution of products through the E-shop are governed by the laws of the Republic of Estonia.
We reserve the right to change the Terms and Conditions of Sale and the prices of products and services in the E-shop. We will inform you of any changes in the E-shop environment. The conditions and prices valid at the time of the transaction shall apply to the transaction.
The range of products, prices and discounts may differ from the range of products, prices and discounts available in the pharmacy.
1. Validity of the sales contract, commercial and price information
- Terms of sale apply to the purchase of goods from the E-shop. AS Surgitech is the responsible processor of personal data, which transfers the personal data necessary for making payments to the authorized processor Maksekeskus AS. The price includes a fee for the
delivery of the goods. - The fee for the delivery of the goods depends on the method of delivery. The delivery fee is displayed to the buyer when completing the order.
- Information about the product is provided in the E-shop directly next to the product.
2. Ordering procedures, placing and payment of orders
- When completing the order, the Buyer is obliged to provide the necessary information for the execution of the order: first and last name, address, contact telephone number and, if possible, e-mail address.
- If the Buyer and the recipient of the goods are different, the The buyer must also provide information about the recipient.
- In the event that the information provided by the buyer is incorrect and/or incomplete, AS Surgitech does not guarantee the proper fulfillment of the order. If possible, AS Surgitech will contact the Buyer to clarify incorrect or incomplete data.
- When completing the order, the Buyer confirms that he agrees with the conditions set forth in these general ordering conditions and undertakes to fulfill them.
- The Buyer selects the desired the product, determines the quantity, payment for the product and the method of delivery and confirms the order.
- Products can be added, deleted and changed in the shopping cart.
- The delivery method is selected and the delivery fee is calculated in the shopping cart.
- It is possible to pay for the order confirmed by the buyer via the bank link provided by the Payment Center. Paying via bank link is a fast and secure way to pay in the e-shop. When paying via a bank link, you will be directed to the internet bank of your choice after completing the order. There you will see a pre-filled payment order with the amount to be paid. Confirm the payment and then press the “Return to merchant” button. Pressing the “Back to merchant” button is very important, because if you don’t do it, it may happen that the information about the success of the payment does not reach us and the execution of the order is unnecessarily delayed.
- The order is considered successfully completed when you have made the payment.

- We will send the notification with the order confirmation to the Buyer via e-mail.
- If you wish to cancel the order, please contact us: tellimused@surgitech.ee (including the costs of delivering the goods) immediately, but no later than within 2 working days of sending the notice.
- AS Surgitech undertakes to deliver correct and complete products to the Buyer.
3. Delivery

- Shipments generally arrive at the destination specified by the Buyer within 3-7 working days from the entry into force of the sales contract.
- Shipping costs are borne by the Buyer, and the corresponding price information is displayed next to the shipping method.
- Delivery within Estonia is FREE for orders from €40.
- If the total amount of the goods you ordered is less than €40, a shipping fee will be added: Omniva parcel machine €2.99; Omniva post office €3.80.

It is also possible to pick up the package yourself at Pärnu mnt 148, Tallinn on weekdays from 9:00 a.m. to 5:00 p.m. after receiving the order confirmation.The warehouse is closed on Saturdays, Sundays and public holidays. If you pick up the goods yourself, no transport fee will be added to the order.
- When ordering with Omniva, when the package arrives at the parcel machine, you will receive an SMS message on your mobile phone with the location of the parcel machine and the door code.

4. Right of withdrawal, return and exchange of products
- After receiving the order, the buyer has the right to withdraw from the contract concluded in the e-shop within 14 days.
- The right of withdrawal does not apply if the buyer is a legal entity.
- In order to return the goods, a a statement of withdrawal from the purchase of the goods and send it to the e-mail address tellimused@surgitech.ee within 14 days of receiving the goods at the latest. The standard form for withdrawal can be found here: withdrawal
- In order to exercise the 14-day right of return, the ordered goods must not be used in any other way than is necessary to verify the nature, characteristics and functioning of the goods in a way that is allowed for testing the goods in a physical store.
- If the goods have been used for a purpose other than what is necessary to verify the nature, characteristics and functioning of the goods, or if they show signs of use or wear, Surgitech AS has the right to reduce the refundable fee according to the decrease in the value of the goods.
- The buyer has no right of withdrawal regarding the products. , which are not eligible for return for health protection or hygiene reasons and if it has been opened after delivery (e.g. cosmetics).
- The costs of returning the goods are borne by the buyer, unless the reason for eb in the fact that the item to be returned does not correspond to the item ordered (e.g. wrong or defective item).
- The customer must return the item within 14 days after submitting the application or provide proof that he has handed over the item to the carrier within the aforementioned period .
- Items ordered from the e-shop can also be returned to our office at Pärnu mnt 148.
- AS Surgitech will return the returned item to the Buyer immediately upon receipt, but no later than 14 days after receiving the withdrawal request, all fees received from the Customer under the contract. AS Surgitech will return the amount paid by the Customer to the same current account from which the payment was made.
- AS Surgitech may refuse to make refunds until it has received the item that is the subject of the contract or until the Customer has provided evidence that it has returned the item , depending on which occurs earlier.
- If the Buyer has explicitly chosen a delivery method other than the cheapest usual delivery method offered by AS Surgitech, AS Surgitech does not have to return the cost to the Buyer that exceeds the cost associated with the usual delivery method. AS Surgitech has the right to withdraw from the sales transaction and demand the return of the goods from the Buyer, if the price of the goods in the online store is marked significantly below the market price of the goods due to an error.
- AS Surgitech does not make cash refunds.
- AS Surgitech is not responsible for defects that have arisen after the delivery of the goods due to the Customer’s actions or inaction (incorrect use, accident, etc.) or if it is with normal wear due to unusual use.
- If the goods purchased from the e-store have defects for which AS Surgitech is responsible, AS Surgitech will repair or replace the defective goods. If it is not possible to repair or replace the goods, AS Surgitech will return to the Customer all fees included in the sales contract.
5. Right to lodge a complaint
- AS Surgitech is responsible for the non-compliance or deficiency of the goods sold to the Buyer with the contract conditions, which already existed at the time of handing over the item and which appear within up to two years from the handing over of the goods to the Buyer. It is assumed that the defect already existed at the time of handing over the thing to the buyer during the first year. Refuting the corresponding assumption is Surgitech’s responsibility.
- If a defect appears, the buyer has the right to contact AS Surgitech within two months at the latest by sending an e-mail to the address tellimused@surgitech.ee or by calling Mon-Fri 9:00 – 17:00 at 6460660.
- AS Surgitech is not responsible for defects that have occurred after the goods have been handed over to the buyer.
- If e -the goods purchased from the store have defects, for which AS Surgiteach is responsible, AS Surgitech will repair or replace the defective goods. If it is not possible to repair or replace the goods, AS Surgitech will return to the buyer all fees included in the sales contract.
- AS Surgitech will respond to the buyer’s complaint in writing or in a form that enables written reproduction within 15 days.
6. Dispute settlement
- The legislation of the Republic of Estonia has been taken into account in these contract terms and purchase-sale order contracts. All disagreements are tried to be resolved through negotiations, taking into account the interests of the customer, in order to find the best possible solution.
- If the Buyer has any complaints about the AS Surgitech online store, they should be sent to the e-mail address tellimused@surgitech.ee or call 6460660 (Mon-Fri 09:00-17:00).
- If the Buyer and AS Surgitech cannot resolve the dispute by agreement, the Buyer has it is possible to contact the Consumer Disputes Commission. The competence of the Consumer Disputes Committee is to resolve disputes arising from the contract concluded between the Buyer and AS Surgitech. Review of the buyer’s complaint by the commission is free of charge. The buyer can turn to the European Union consumer dispute resolution platform here.
7. Rights and obligations of the seller
- The Seller may make changes to the AS Surgitech e-store purchase instructions without notifying the Buyers separately, by changing the information on the website.
- If for some reason the ordered product is out of stock or it has become impossible to sell it, we offer the Buyer equivalent or better goods instead. If the Buyer does not want to replace the selected item, we will return the money paid no later than 2 working days after sending the notification.
- We are not responsible for possible damage to the Buyer due to technical problems. Technical problems mean factors beyond AS Surgitech’s control, such as internet connection interruptions, server failures, etc.
- AS Surgitech is not responsible for the later delivery of the ordered product in case of delay by the postal authority and other reasons beyond our control.
